Conviction of escape without force or violence, with sentence of 6 years is modified from violation of Penal Code section 4530(b) to 4530(c), but is otherwise affirmed over claims that the trial court erred by: 1) admitting a confession defendant made during plea negotiations at a pretrial proceeding; and 2) imposing the upper term of a sentence where the aggravating factors were not found true by a jury.
