In lawsuit brought by daughter against father seeking accounting of investment father made for daughter without her knowledge, trial court erred in: 1) granting summary judgment to father where triable issues of fact exist as to whether the funds advanced were a loan or a gift; 2) denying daughter's motion to compel production of records of company in which she held a one percent interest; and 3) failing to permit daughter to amend her complaint to seek damages from father for conversion and breach of fiduciary duty.
