California Court of Appeal
Shin v. Ahn, B184638
In case where defendant's golf tee shot hit plaintiff in the head, order granting plaintiff's motion for new trial, which had the effect of reversing summary judgment in defendant's favor, is affirmed over claims that: 1) the new trial order is defective because it fails to identify either the grounds or the reasons for granting a new trial; and 2) the order cannot stand because the law provides that every golfer assumes the inherent risk of being hit by a golf ball.
