Bridgeman v. McPherson, C050528

Judgment requiring defendant secretary of state to refrain from enforcing Elections Code section 3103.5, which requires a special absentee voter to sign an oath waiving right to keep ballot secret, is reversed as the constitutional guarantee of secret ballot must be balanced against the right of voters to cast a vote, and fax voting is necessary to some voters overseas to vote in California.
