California Court of Appeal

People v. Misa, D046582

Conviction of one count of torture and two counts of assault with a deadly weapon and by means of force likely to cause great bodily injury is affirmed over claims that: 1) there was insufficient evidence to support conviction of torture; 2) the torture statute is unconstitutionally vague; and 3) the court improperly imposed a serious felony prior enhancement twice, once on the torture count and once on the second assault count.
