Sustaining of demurrer to complaint brought by surviving family and the estate of the decedent against four police officers who shot the decedent 22 times while he was fleeing arrest, is reversed despite claims that a federal jury verdict and judgment in favor of defendants in prior federal civil rights precludes the same plaintiffs from bringing a state negligence action against the same defendants based on the same facts.
