Pietrobon v. Libarle, A109972

Judgment for plaintiff for breach of a settlement agreement is affirmed over claims that: 1) there was no written settlement agreement and the court erred in ruling that the four-year statute of limitations for an action upon a contract founded upon an instrument in writing applied; and 2) if there was a written agreement, it did not satisfy the statute of frauds because defendant had never signed it.
