California Court of Appeal

Sanders v. Yarborough, B179103

An order striking an inmate's civil rights complaint and dismissing the action for noncompliance with filing fee statutes is reversed where: 1) an erroneous order waiving plaintiff's fees and costs relieved him of his obligation to pay them; 2) the trial court erred in interpreting the statute at issue; 3) the trial court lacked authority to terminate the action; and 4) plaintiff should have been allowed to file a certified statement of account.
