California Court of Appeal
In re Burns, C049060
An order granting a writ of habeas corpus to a murder defendant is reversed where the trial court erred in finding the Board of Prison Terms had no reasonable justification for deferring defendant's parole consideration for five years since the Board's decision had a factual basis and was supported by evidence in the record.
