Order granting a new trial in an action for false arrest and wrongful imprisonment is affirmed where there was no abuse of discretion in the grant of a new trial for "irregularity of the proceedings" where a judge who granted nonsuit for defendant in the case had discussed the case with a previously disqualified judge.
