California Court of Appeal

IN RE CIPRO CASES I AND II, D043543

The trial court did not abuse its discretion in granting an order for class certification, however, the trial court erred where the class is overbroad to the extent it includes purchasers of the antibiotic Cipro who paid a flat copayment when they would have paid for a generic substitute under their health insurance.
