PEOPLE v. COKER, C041997

Defendant's letter of apology to victim, which was circumstantial evidence that he committed the crime, is admissible since its potential for prejudice was minor and the defense counsel had an opportunity to cross-examine. Furthermore, the sentence imposed is not unauthorized because it is in accord with express legislative purpose.
