California Court of Appeal

F & H CONSTR. v. ITT HARTFORD INS. CO. OF THE MIDWEST, C042707

The insured delivered subgrade materials to plaintiff, and plaintiff used those materials in construction project before discovering the defect. This did not constitute "property damage" within the meaning of the applicable insurance policy, and summary judgment in favor of insurance company was proper.
