PEOPLE v. HARDACRE, H025867
The speed trap exclusionary rules set forth in Vehicle Code sections 40803 and 40804 apply only when a defendant is charged with an offense involving the speed of a vehicle; thus, the statutes do not apply to the present case, in which defendant was charged with driving under the influence. The order granting defendant's motion to suppress is reversed.
