GARAMENDI v. GOLDEN EAGLE INS. CO., A097435

Judgment rendered against subcontractor was not "default judgment" where subcontractor answered complaint but failed to appear at trial. Judgment was therefore evidence of liability of subcontractor's insurer, but case was remanded for determination whether insurer was estopped from asserting coverage defenses because it failed to defend subcontractor at trial.
