California Court of Appeal
HAMBURG v. WAL-MART STORES, INC., A101829
Lower court erred in granting summary judgment to defendant in a suit for false arrest and false imprisonment of protesters at one of its stores. The constitutionality of defendant's "time, place and manner" restrictions for speech on its premises was not dispositive of the issue in this case, namely, whether plaintiffs were unlawfully placed under arrest by defendant's employee.
