IN RE VAN HOUTEN, E032032

Trial court erred in granting habeas petition of Manson murderer. The crime was of such a heinous, atrocious and cruel character that this factor alone satisfied the "some evidence" standard applicable to parole board decisions; the board was not required to explain why the character of the crime outweighed other factors in this instance.
