California Court of Appeal

TREMPER v. QUINONES, B165218

Pursuant to the good faith improver statute, the trial court erred in granting defendant the right to remove improvements from plaintiffs' property without also requiring him to reimburse plaintiffs for costs and fees incurred in litigating their property rights; the landowner's recovery is not limited to losses incurred in litigating the cross-complaint of the party seeking relief as a good faith improver.
