MATEEL ENVTL. JUSTICE FOUND. v. EDMUND A. GRAY CO., A100075, A100279

Trial court erred in granting summary judgment to defendants, distributors of plumbing parts that allegedly discharge lead into drinking water in violation of the Safe Drinking Water and Toxic Enforcement Act. The Lead and Copper Rule is not a Tier 1 test; therefore, defendant did not show plaintiff's failure to conduct an existing, Tier 1 test.
