Parties entered an agreement whereby plaintiff funded improvements to city property in exchange for credit against license fees. Trial court erred in sustaining city's demurrer because the alleged breach of the covenant of good faith and fair dealing constitutes a breach of contract for which plaintiff may recover damages.
