In a drug possession and driving under the influence case, the district court properly found the defendant ineligible to be sentenced pursuant to the Substance Abuse and Crime Prevention Act of 2000 (Prop. 36) where the defendant's violation of Vehicle Code section 23152(b) excluded him from Prop. 36 treatment.
