Whether an attorney should be disqualified in a successive representation case depends on 1) the relationship between the legal problem involved in the former and current representation, and 2) the relationship between the attorney and the former client with respect to the legal problem involved in the former representation. Case is reverse and remand, with directions to trial court to rehear motion to disqualify respondent's firm and to apply the correct legal standard --the "substantial relationship" test.
