California Court of Appeal

A class action under the federal Telephone Consumer Protection Act of 1991, which regulates unsolicited "junk fax" advertisements, may be maintained in state court because the California Legislature has not prohibited such suits. Ruling that plaintiffs could not pursue a TCPA claim in state court is reversed.
