State Personnel Board (SBP) has standing to challenge a memorandum of understanding (MOU) which precludes it from carrying out its constitutionally mandated duty to review disciplinary actions. The MOUs violate article VII, section 3, subdivision (a) of the California Constitution because they restrict SPB's adjudicatory authority to review disciplinary actions taken against state civil service employees.
