GRANT v. COMP USA, INC., H023839

Under Government Code section 12965, an employee's right to sue arose by operation of law when the Department of Fair Employment and Housing failed to resolve the matter within one year from the time she filed her administrative complaint. Employee's failure to obtain a second right-to-sue letter does not preclude a finding that she exhausted her administrative remedies.
