PEOPLE v. FLOOD, C040171

Though it was the trial court's function to determine whether a prior conviction constituted a "strike", defendant is not entitled to a reduction of a stipulated prison sentence where he gained the benefit of his plea bargain, thus he cannot prevail on claims that the Three Strikes law does not apply and that his term must be reduced. (Corrected)
