California Court of Appeal

DE GREZIA v. SUPERIOR COURT OF LOS ANGELES COUNTY (BLUE CROSS OF CALIFORNIA), B157914

A party who rescinds a contract with an arbitration clause may not later demand arbitration, thus the trial court's order compelling arbitration is vacated. Arbitration shall proceed only on the question of insurance company's purported rescission of the insurance policy.
