California Court of Appeal
GATES v. DISCOVERY COMMUNICATIONS, INC., D039399
Because Briscoe v. Reader's Digest Association, Inc. (1971) 4 Cal.3d 529, is no longer the law when dealing with the tension between the right of privacy and the rights of freedom of the press and speech, the trial court erred in failing to strike an action for invasion of privacy against "true crime" television show, pursuant to the Anti-SLAPP statute.
