PEOPLE v. GOLDBERG, A097650

The trial court did not err in refusing to reinstate defendant's probation, as Penal Code section 1210.1(e)(3)(D) does not apply to a defendant who was on probation for a nonviolent drug possession offense and driving under the influence on the effective date of the statute.
