Plaintiffs produced sufficient evidence showing that Department of Health Services (DHS) policies interpreting federal and state statutes relating to the Medicaid program were regulations within the meaning of the Administrative Procedure Act (APA), and should have been promulgated in accordance with the APA, to defeat summary judgment.
