California Court of Appeal

IN RE STARR, A097688

The question with respect to Probate Code section 12401's presumption of death is whether a missing person's absence is capable of a satisfactory explanation other than by death, and the trial court erred in applying the presumption where such an explanation existed for an insured's absence.
