The rule of first resort to the Hague Convention on the Taking of Evidence Abroad in Civil or Commercial Matters has been superseded by a more particularized approach, and the burden of persuasion falls on the party proposing discovery under the Convention. A French corporation waived the discovery procedures available under the Convention.
