A custody order is reversed where the social services agency 1) failed to provide to the juvenile court information as to whether proper notice had been given to Indian tribes under the Indian Child Welfare Act, and whether the post-notice procedural provisions of the Act apply, and 2) made no determination as to whether the mother waived application of those provisions if they apply.
