NORVIEL v. NORVIEL, H021925

Spouses must be "living separate and apart" in order to separate, under Family Code section 771(a), and such a finding requires contemporaneous conjunction of intent to separate and conduct evidencing that intent, including some objectively ascertainable form of physical separation.
