Based on testimony of a staff psychiatrist, evidence supported a finding that defendant could not be kept in remission within the meaning of the Mentally-Disordered Defendant (MDO) law (Penal Code section 2960); in a proceeding for continued treatment, court was not required to instruct jury to presume that defendant was not an MDO.
