SARATOGA FIRE PROT. DIST. v. HACKETT, H022553

In eminent domain proceeding where market value of property increased between valuation and trial, constitutional requirement of "just compensation" mandates that exclusion of evidence of fair market value of property at time of trial amounts to "miscarriage of justice" requiring reversal of judgment.
