Where fact issues existed as to 1) a contractor's misrepresentations about license status and 2) a homeowner's reliance on same, an injured worker may not have been an "employee" of the homeowner under Labor Code section 2750.5; OSHA regulations may apply to homeowners in the context of tree-trimming for non-commercial, personal benefit.
