A surety is not bound by a judgment against its principal in a prior action to which surety was not a party, and therefore, surety here is not bound by provisions in earlier judgment awarding attorney fees and statutory penalties to plaintiff; but, upon an appropriate showing, liability on stop notice release bond may extend to attorney fees and statutory penalties.
