RENEE v. SUPERIOR COURT OF ORANGE COUNTY (O.C.S.S.A.), G029791

The trial court erred in applying the California Supreme Court's interpretation of Welfare and Institutions Code section 361.5(b)(10), because the California Legislature immediately overrode that interpretation by amending the statute, which provides an exception to the doctrine of law of the case; thus, the Legislature intended its amendment to be a clarification, and applied to all cases still pending.
