Where defendant was convicted by a jury of misdemeanor child abuse, but the trial court dismissed the case finding that the evidence was insufficient to support the jury verdict, appeal of the trial court's order was allowable, as appeal could only reinstate the conviction, and does not cause a double jeopardy problem.
