Although a criminal defendant's right to confidentiality must be protected in proceedings held pursuant to Evidence Code section 1043, whenever possible, the question whether the defendant has shown good cause in a motion for confidential discovery should be tested by the adversary process; thus the City Attorney may review the motion and file an opposition under seal.
