Although a criminal defendant's right to confidentiality must be protected in proceedings held pursuant to Evidence Code section 1043, whenever possible the question whether the defendant has shown good cause in such motion for confidential discovery should be, tested by the adversary process; thus the City Attorney may review the motion and file an opposition under seal.
