Under Code of Civil Procedure section 1161.1(c), a written lease provision which states that acceptance of partial payment of rent will not waive the landlord's rights, supports the statue's "actual notice" requirement, even if landlord did not re-notify the tenant prior to actually accepting the partial payment.
