SMITH v. PACIFICARE BEHAVIORAL HEALTH OF CALIFORNIA, INC., B142321

The McCarran-Ferguson Act, 15 USC 1011 et seq., overrides the Federal Arbitration Act, 9 USC 1 et seq., and precludes its preemptive impact on Health and Safety Code 1363.1, which imposes certain disclosure requirements as a predicate to the enforcement of arbitration clauses contained in plan subscriber agreements.
