PEOPLE v. FELIX, B147530

Penal Code section 422, which makes it a crime to threaten another with great bodily injury or death, does not apply where a patient makes a threat to a psychotherapist if he does not intend for the remarks to reach the third party even if the psychotherapist is required by law to warn the third party.
