PEOPLE v. BOWERS, C030938
Under Penal Code section 1089, a trial court may not dismiss a juror for failure to deliberate if the juror listened to all of the evidence, participated in the discussions concerning the evidence in the jury room, and remained willing and able to vote concerning the verdict.
