California Court of Appeal
Hernandez v. Hillsides, Inc., B183713
Summary judgment in favor of defendants, in case involving placement of video camera in office that plaintiffs shared, which is part of residential facility for abused children, is reversed as: 1) plaintiffs need not establish that they were actually viewed or recorded in order to succeed on a cause of action for invasion of privacy; 2) defendants failed to conclusively establish that plaintiffs had a diminished expectation of privacy, or that their actions were sufficiently justified by the need to protect the children residing at their facility.
