Dutchess County Department of Social Services, appellant; Gilbert D., Sr. (Anonymous), et al., respondents.  (Proceeding No. 5).

Decided: May 31, 2005

HOWARD MILLER, J.P., DAVID S. RITTER, GLORIA GOLDSTEIN, and ROBERT A. SPOLZINO, JJ. Ian G. MacDonald, County Attorney, Poughkeepsie, N.Y. (Laura Gail Skojec of counsel), for appellant. Steven A. Feldman, Uniondale, N.Y., for respondent Gilbert D. Yasmin Daley Duncan, Brooklyn, N.Y., for respondent Rita R. Joseph A. Rihn, Poughkeepsie, N.Y., Law Guardian for the children Stephania D., Mary D., Gilbert D., and Tabitha D. Carl S. Chu, Fishkill, N.Y., Law Guardian for the child Robert D.

In five related child protective proceedings pursuant to article 10 of the Family Court Act, the petitioner appeals from an order of the Family Court, Dutchess County (Sammarco, J.), dated March 4, 2004, which denied the petitions and dismissed the proceedings.

ORDERED that the order is affirmed, without costs or disbursements.

Contrary to the appellant's contention, it failed to prove by a preponderance of the evidence that one of the subject children was sexually abused by another as alleged and, therefore, that the respondent parents were chargeable with neglect for failing to protect against the same (see generally Matter of Nicole V., 71 N.Y.2d 112, 524 N.Y.S.2d 19, 518 N.E.2d 914;  Matter of Brittany K., 308 A.D.2d 585, 765 N.Y.S.2d 254;  Matter of Latisha W., 221 A.D.2d 645, 634 N.Y.S.2d 510).
