Court of Appeal of Louisiana, Fourth Circuit.

STATE OF LOUISIANA v. WILL MOFFETT

NO. 2017-K-0022

Decided: January 09, 2017

The record before us does not demonstrate that the trial judge has abused her very broad discretion, particularly at this stage of the proceedings. See La.C.Cr. P. art. 726.

JUDGE JOY COSSICH LOBRANO

JUDGE ROSEMARY LEDET

I respectfully dissent from the denial of the writ. Evidence of Defendant's alleged mental illness is not admissible under La. C.Cr.P. art. 651. Further, Defendant failed to provide the State of Louisiana with the notice required under La. C.Cr.P. art. 726. For these reasons, I respectfully dissent.

JUDGE MADELEINE M. LANDRIEU
