ORDER

On July 17, 2026, Magistrate Judge Brian McKay conducted a preliminary hearing and a hearing on the government's motion to detain Defendant Young and entered orders setting conditions for Defendant Young's release. Doc. Nos. 21–24. The release order was stayed pending the government's motion for review under 18 U.S.C. § 3145(a). On July 23, 2026, the government filed its motion for review and because Defendant Young was originally charged by criminal complaint, the motion for review was before United States District Judge Brantley Starr. On August 5, 2026, a grand jury issued an indictment as to Defendant Young. At the August 6, 2026, hearing before Judge Starr, the government presented additional evidence. Judge Starr then referred the detention issue back to the magistrate judge to determine based on the additional evidence provided by the government. The magistrate judge still found that Defendant Young was releasable with the conditions imposed, stating that “the new evidence adds nothing to the Court's assessment of flight risk or danger.” Doc. No. 45 at 27. On August 12, 2026, this case was transferred to this court. Doc. No. 39.

On August 18, 2026, the Findings, Conclusions and Recommendation of the United States Magistrate Judge (“Report”) (Doc. 45) was entered, recommending that the court deny the government's motion for review of the release order as to Defendant Domminique Dealvin Young. On August 21, 2026, Defendant Young filed an unopposed motion requesting to waive the 14-day objection period and stating that the government does not intend to appeal the magistrate judge's Findings as to Defendant Young. See Doc. No. 47; 28 U.S.C. § 636(b)(1)(C). The court notes that the Report addresses the issue of the government's motion for review of the release order of co-defendant Reginald Wallace Garner, but this court will address that in a later order.

Defendant Young has been indicted for (1) conspiring to possess with intent to distribute a large quantity of cocaine in violation of 21 U.S.C. §§ 846 and 841(b)(1)(A); (2) posing with intent to distribute a controlled substance, aiding and abetting in violation of 21 U.S.C. §§ 841(a)(1), (b)(1)(B) and 18 U.S.C. § 2; and (3) posing a firearm in furtherance of a drug trafficking crime in violation of 18 U.S.C. § 924(c)(1)(A)(i). Doc. No. 36. Defendant Young is 33 years old and has two entries of criminal history: (1) a 2014 arrest in Richardson for a traffic offense of which the disposition is unknown and (2) a 2017 misdemeanor theft charge in Dallas that the prosecutor rejected. Young Rpt. at 2. At the July 17, 2026, preliminary hearing and hearing on detention the magistrate judge found that Defendant Young could be released with conditions.

After considering the pleadings, file, record, Report, and applicable law, the court determines that, the findings and conclusions of the magistrate judge are correct as to Defendant Young and accepts them as those of the court. The court grants the Defendant's unopposed motion to waive the 14-day objection period and denies the government's motion for review of the release order as to Defendant Young. The court lifts the stay of the release order as to Defendant Young and directs the U.S. Marshal to release Domminique Dealvin Young forthwith.
